For the purposes of this title, the following terms shall be given the meaning described herein:
(a) "Congress" meaning the Congress of teh Federated States of Micronesia
(b) " Instrumentality" means instrumentality of the National Gernment as extablished by national statute, including the FSM Devlopment Bank, College of Micronesia-FSM and FSM Petroleum Corporation.
(c) "National funds" means public funds of National Government as follows:
(1) General fund created by section 208 of title
55 of the Code of the Federated States of Micronesia (Annotated) and revolving funds established under chapter 6 of title 55 of the Code of the Federated States of
Micronesia (Annotated);
(2) COMPACT Sector Funds or COMPACT Trust Funds, but does not include sector funds specifically earmarked for the States;
(3) Foreign aid, irrespective of the disbursement mechanism and who the grantee, borrower, or beneficiary is, if the National Government is a guarantor or by the terms of the grant or loan, responsible for managing or monitoring the use of the funds, or accountable for the use thereof;
(4) Funds held by corporations and other entities created by national statute; and
(5) All other funds appropriated by the Congress to the states or state authorities for any purpose, except those funds appropriated by Congress to the States pursuant to a revenue-sharing provision of the Constitution of the Federated States of Micronesia.
(d) “Official” means a public official.
(e) “President” means the President of the
Federated States of Micronesia.
(f) “Public corruption crimes” are national crimes defined under subchapter 3 of Chapter 5 of title 11 of the Code of the Federated States of Micronesia.
(g) “Public official” means President, Vice President, Members of Congress, Chief Justice and Associate Justices of the FSM Supreme Court, heads and deputy heads of the executive departments, heads of offices, agencies and public corporations of the National Government, and head or person in charge of any other agency or instrumentality of the National Government.
